China former top graft buster indicted on bribery charges
BEIJING (AP) — A former top graft buster at China’s ministry for intelligence and counterintelligence has been indicted on bribery charges, just weeks before a major congress of the ruling Communist Party whose leader Xi Jinping has made fighting corruption a signature issue.

Wednesday's indictment of Liu Yanping, who headed the State Security Ministry’s branch of the party’s Central Commission for Discipline Inspection was a further reminder of Xi’s vow to attack corruption “amongst both the flies and tigers.”

On Friday, former deputy police minister Sun Lijun was given a death sentence with a two-year reprieve on charges of manipulating the stock market, taking bribes and other offenses. The case involved at least two former Cabinet officials.

State media said Liu had accepted “huge” amounts of property from others in return for favors. Those often include derailing investigations or offering promotions for cash.

He was expelled from the party earlier this month in a sign he would be indicted, tried and almost certainly handed a lengthy prison term.

In that initial investigation, it was found that Liu had “lost his ideals and convictions," was “downright corrupt politically." He “”traded political power for interests and distorted his power into a tool to seek political capital, personal benefits, and wealth," the reports said.

Liu was found to have “engaged in superstitious activities" and accepted invitations to golf games, banquets, tours, and medical services from private business people “that may compromise his impartiality in the performance of official duties," the reports said.

In Sun's case, a former justice minister and a former ruling party official who were accused of colluding with him received similar penalties. Sun was convicted of collecting 646 million yuan ($91 million) in bribes and charged with using his official position in 2018 to manipulate stock trading to help a trader avoid losses. He also was accused of selling official jobs and abandoning his post during the COVID-19 outbreak.

Earlier, Sun was named in a lawsuit by the U.S. Justice Department against Las Vegas casino mogul Steve Wynn seeking to compel Wynn to register as a foreign agent. The department cited lobbying work it says Wynn performed for the Chinese government.

The lawsuit says senior officials including Sun wanted Wynn’s help in trying to have a Chinese citizen’s visa application denied, according to the complaint. Beijing wanted the man, who was charged with corruption and sought political asylum, returned to China.

Xi launched his anti-graft campaign shortly after taking over as party leader in late 2012. It has at times been seen as a tool to remove political rivals and intimidate the vast bureaucracy into doing his bidding. It also has sometimes sparked a public backlash, as in the case of the rigid enforcement of zero-COVID restrictions that have hobbled the economy and upended the lives of millions.

At next month’s party congress, Xi is expected to try to break with tradition and award himself a third five-year term as leader.

John O’Hara sues former DA, assemblyman for ‘malicious prosecution’ in ’90s conviction • Brooklyn Paper
A former Brooklyn district attorney and assemblyman colluded to fabricate evidence and bribe witnesses so they could convict a political rival of voter fraud, a civil complaint filed Tuesday in Kings County federal court alleges.

Sunset Park attorney John O’Hara, who is running for judgeship in Brooklyn civil court, said he’s bringing suit in order to drag defendants Charles Hynes and James Brennan through the legal system following a two-decade struggle to clear his name.

“You know what I was doing for the last 20 years,” he said. “Now you know what I’ll be doing for the next 20 years. I’m in no hurry.”

Then District Attorney Hynes pursued O’Hara’s conviction throughout the early ’90s, and in 2000 finally succeeded in getting a guilty verdict after an unprecedented three trials — making the attorney the first New Yorker since legendary suffragette Susan B. Anthony to be convicted of voter fraud. He was sentenced to 1,500 hours of community service, fined $20,000, and prohibited from practicing law until 2008, when he was reinstated to the bar.

A conviction review unit assembled by Hynes’ successor Ken Thompson found evidence to exonerate O’Hara in January, and ever since the lawyer has vowed to seek justice for what he called malicious prosecution motivated by cutthroat, political greed.

The suit claims that O’Hara landed on Assemblyman Brennan’s radar when he challenged another Assembly candidate backed by the powerful state legislator in 1994 — a bid for office that followed the lawyer’s four previous, unsuccessful attempts to unseat members of what he calls Brooklyn’s “Democratic machine.”

Brennan, working with his chief of staff and another attorney, hired a private eye who illegally nabbed copies of O’Hara’s state tax returns while spying on him, the complaint alleges. The assemblyman tried to derail O’Hara’s ’94 campaign, and his subsequent assembly bid in 1996, by suing the political outsider in civil court, but each case was dismissed.

The pol then colluded with the district attorney to sue his rival for voter fraud, claiming O’Hara lived on 61st Street when he voted in an election district 14 blocks away, according to the complaint, which alleges Brennan and Hynes intentionally failed to record their surveillance of the lawyer in order to avoid giving evidence in his favor to a grand jury.

O’Hara claims he lived at his girlfriend’s 47th Street apartment throughout the three trials, but that the pol and top prosecutor paid neighbors to argue he lived elsewhere.

Brennan would camp outside the 66th Precinct waiting for police detectives investigating the case so he could direct them in their probe, the complaint claims. In addition, it states that Hynes subpoenaed O’Hara’s mail — which was opened before it was returned — and alleges the lawyer was constantly followed by a man in a black town car.

Hynes declined to comment on the allegations, saying he’s been sued many times and his policy is not to comment on pending litigation.

A spokesman for Brennan said the former pol is innocent and plans on counter-suing O’Hara for libel.

“The complaint is meritless and malicious, and obviously timed to get publicity for his campaign,” said Stuart Marques. “We plan to countersue for libel.”

The massive 41-page complaint the attorney filed this week follows an initial notice that he filed in Brooklyn civil court in February.

Shomrim patrol chief pleads not guilty to raping 16-year-old girl
The president of the Shomrim neighborhood patrol pleaded not guilty Friday to raping a 16-year-old girl.

Jacob Daskal, 59, was arrested Thursday after authorities set up a recorded call between the politically-connected Brooklyn bigwig and his alleged victim, prosecutors said.

Daskal showed no emotion as Brooklyn Supreme Court Justice Deborah Dowling ordered him held on $75,000 bond.

Dowling also ordered him to turn over his passport.

The head of the Orthodox Jewish private security group based in Borough Park walked out of the courthouse minutes later surrounded by six women and four men.

Daskal, dressed in traditional Orthodox Jewish garb, declined to comment.

He was hit with a 20-count indictment — including two counts of felony third-degree rape and six counts of sexual abuse — for allegedly preying on the teen between August and November of last year.

A well-known community leader with ties to politicos and police, Daskal has donated money to state Sen. Simcha Felder (D-Brooklyn) and Mayor de Blasio in his 2009 run for public advocate.

The Shomrim's links to law enforcement have been a subplot in the ongoing NYPD gun-permit-fixing scandal.

Daskal was not charged in the case involving two businessmen and several NYPD supervisors.

But he has been featured in the press as an outspoken defender of the Shomrim even as it has faced criticism in recent years of operating as an overzealous vigilante group.

The group's reputation took a hit in 2013 when a Brooklyn jury cleared a man of nearly all charges in connection with a shooting of four Shomrim members.

The Jewish security patrol tailed the man after reporting that he was seen masturbating near children.

The man, David Flores, pulled out a gun as his pursuers converged on him and shot the four Shomrim members.

The 37-year-old Brooklyn man was hit with 16 charges, including attempted murder and assault.

But jurors convicted him of only a single count of carrying an illegal gun, placing much of the blame for the 2010 incident on the Shomrim. The masturbation allegation fell apart at trial.

"Nobody did anything wrong," Daskal said after the jury announced its verdict.

Flores, who was sentenced to 12 years in prison on the gun charge, remains locked up.

His brother Dennis Flores called the arrest of Daskal, who was involved in the fracas, the "beginning of justice."

"Karma's a bitch," Dennis Flores said.

COUNCILMAN GREENFIELD COMPARES SUPER JEWISH DISTRICT TO THE GHETTO

BROOKLYN,NY

Brooklyn, NY - Councilman David G. Greenfield (D-Brooklyn) was joined by dozens of Jewish community leaders today to protest the creation of the one so-called "Super Jewish" district that was drawn to replace the six senators currently representing the predominantly Orthodox neighborhoods of Borough Park, Midwood, Flatbush and Kensington.

At a press conference today in Borough Park, Greenfield ripped the proposed district drawn by New York State Legislative Task Force on Demographic Research and Reapportionment as the product of a backroom political deal that will only serve to dilute the voice and power of the largest Orthodox Jewish population in the United States of America.

"Let's be clear, this is not a Super Jewish district but rather a Super Ghetto district that if allowed to remain in place will cause the Jewish community to lose multiple voices in Albany. That will mean less services, less funding and less political power for America's largest Jewish community right here in Brooklyn. Quite frankly, it will be very easy for the political establishment to marginalize the one senator representing the entire Jewish community. Right now we have six senators representing the Jewish community, and to go to one simply makes no sense. We need at least two, if not three senators, to maximize the community's political power. That's why I urge the Governor to recognize this proposal for what it is -- backroom politics at its worst -- and to veto it," said Greenfield.

Greenfield was joined at the corner of 16th Avenue and 45th Street outside his district office by dozens of local leaders and representatives from community groups to demand that LATFOR go back to the drawing board and produce district lines that serve the public's best interest, instead of the political party or incumbent's best interest. Collectively, these leaders represent tens of thousands of members of the Jewish community. Among those speaking out against dumping all of Brooklyn's Jews into one Senate district were Chaim Deutch, founder of Flatbush Shomrim, Rabbi Chaim Goldberger of Satmar, Mendel Zilberberg of Community Board 12, community leader Rabbi Berish Freilich and Rabbi Yechezkel Pikus of Council of Jewish Organizations of Flatbush.

Also on hand were representatives from Chaveirim, Yad Ephraim, Boro Park Shomrim, Igud L' Hachzokas Torah, Bikur Cholim of Boro Park and Bina Ezras Cholim. In addition, the leaders of local yeshivas including Belz, Gur, Boyan, Gan Yisroel and Satmar joined Greenfield for today's press conference.

"Having just one person, no matter who that person is, represent us is a step backwards and a step in the wrong direction. I commend Councilman Greenfield for taking this issue up and speaking out against the proposed lines. Diversity in our society not only makes us stronger, but it brings us closer together," said Chaim Deutch of Flatbush Shomrim.

"It is wrong to segregate people based on religion, race or any other factor. This isn't about establishing a super district for Jews, it is about segregating us. We are all one people, citizens of the United States who just want to live our lives under a government that represents them. The community did not ask for this," said Rabbi Chaim Goldberger of Satmar.

Last September, before the lines were drawn, Greenfield stressed two key points while testifying before LATFOR (the redistricting committee). He urged the committee to consider the local Orthodox community's staggering growth over the past decade, when Borough Park was the city's only neighborhood of 100,000 plus residents to see a population increase in the recent census, and to keep in mind the community's unique needs and priorities. Greenfield encouraged the redistricting committee to ensure that the Orthodox Jewish community had "at least two but preferably three senators." Unfortunately, the committee ignored Greenfield's recommendations and instead proposes reducing the Jewish community's representation to a single senator.

Today, Greenfield explained that if the Jewish community were split into two or three districts the community would still be the most sought-after constituency in each of those two or three districts. "If we have a choice to make up 30 to 40 percent of two or three districts or 70 percent of one district, I think it's obvious that we want to be big enough to make a difference but not too big to be marginalized," said Greenfield. As proof, Greenfield pointed to the recent election of US Congressman Bob Turner. While Jews made up only 23 percent of that district, because of Jewish interest in the seat, they made up 33 percent of the vote and clearly were the determining factor for Mr. Turner, who won with only 8 percent of the total vote.

Following today's press conference, Greenfield sent a letter to Governor Cuomo explaining the reasons behind his request and asking the Governor to veto the lines as drawn.

5th Circuit Awards Immunity To Cop Who Decided A Suicidal Man Should Be Tased While He Had A Noose Around His Neck

Oh, Fifth Circuit Court of Appeals. Whatever will you do next?

The qualified immunity complaints of Judge Don Willett notwithstanding, the Fifth Circuit is where you go if you want batshit decisions that run contrary to common sense, much less established constitutional law. If you need a decision that sides with the government — no matter how bizarre the government action — you appeal rational decisions and roll the dice on irrationality.

The Fifth Circuit recently handed us a completely inexplicable decision that said social media moderation isn’t a First Amendment issue. And if it is a First Amendment issue, it’s because private companies are somehow capable of violating constitutional rights. Compelled speech is the name of the game in the Fifth Circuit, which recently sided with Texas’ unconstitutional social media law in a decision handed down by a judge who was appointed by Donald Trump and had previously worked as Texas Governor Greg Abbott’s general counsel.

This is also the same Appeals Court that said qualified immunity protected cops who tased a man soaked in gasoline (but was carrying no weapons), igniting him and the house he was in, killing him and destroying the house.

That brings us to this decision, handed down in August, but somehow escaped my attention. Fortunately, Clearly Established, which tracks qualified immunity decisions, highlighted this one in its most recent roundup.

It’s more of the same for the Fifth Circuit Appeals Court, which remains the cop-friendliest place on earth™. It’s another case where a mental health call turned into an execution, because many cops believe the only response to any unfamiliar situation is the application of violence.

And that’s exactly what happened here. Maria Ramirez placed a 911 call, expressing her concern that her son, 30-year-old Daniel Ramirez, was planning to commit suicide by hanging himself from the basketball hoop in her backyard.

Maria did not tell the dispatcher that Daniel had a weapon because why would she? Daniel was not carrying a weapon. The dispatcher did not tell the responding officer (El Paso PD officer Ruben Escajeda) that Daniel had a weapon because why would they? They had received no information stating anything about the presence of a weapon.

Despite the lack of any information pointing to this being anything more than a distress call seeking help to prevent a suicide, Officer Escajeda decided he was the one in need of saving. From the decision :

When Escajeda arrived minutes later, at 10:40 p.m., he found the lights off. He became concerned, asking himself “Why the house so dark, inside and . . . outside?” Without announcing his presence, he proceeded to the back yard, gun drawn.

An odd response to a suicide call, but to each his own. It gets odder from there. Officer Escajeda’s testimony becomes internally contradictory shortly thereafter.

He decided not to wait for other officers because he felt “urgency to prevent a suicide.”

Good, good, good… except:

Concerned he could be walking into an “ambush,” Escajeda repeatedly ordered Daniel to show his hands to ensure he had no weapon.

So, which was it? Was it a suicide or an ambush? If it was the former, move quickly. If it’s the latter, maybe call for backup. Officer Escajeda, hoping to secure immunity, argued it was both. And these competing concerns justified his use of force — a force deployment that killed the person he claimed mere sentences earlier he was trying to save.

Daniel’s hands stayed around the rope. So, Escajeda holstered his gun, moved closer, and tased Daniel in the abdomen for five seconds. Daniel’s body tensed and Escajeda saw Daniel’s fists squeeze harder and heard a “crunch” or “gargle.” Escajeda then removed the rope from around Daniel’s neck and lowered him to the ground. He administered CPR on Daniel and felt a faint pulse in his neck. Other officers arrived seconds later and assisted Escajeda with CPR. Paramedics arrived soon after and took Daniel to a nearby emergency room where he was pronounced dead at 11:24 p.m. An autopsy concluded Daniel’s death was caused by hanging.

Well, yes. By hanging. But a hanging that could have possibly been prevented, but was instead made inevitable by the officer’s taser deployment, one that definitely appeared to be unjustified.

The lower court denied immunity to the officer, citing precedent that clearly established “officers may not use a taser against a subdued person who neither committed any crime nor who resisted the officer’s authority.”

The Appeals Court, however, disagrees with this basic, logical premise. Instead, it says precedent provides no case on point and, beyond that, the officer said the magic words about fearing for his safety. And that’s enough to give the Appeals Court the opportunity to both award immunity and avoid further discussion of the underlying incident, much less add it to its precedent.

Contrary to the plaintiffs’ arguments, Escajeda did not have Daniel “subdued” and under his control when he used the taser. To the contrary, Escajeda faced a “tense, uncertain, and rapidly evolving” situation, Plumhoff, 572 U.S. at 774, wholly unlike those faced by the officers in Bush, Newman, and Martinez.

Escajeda used the taser precisely because Daniel was not in custody and Escajeda was unsure whether the strange scenario he faced posed a threat to his safety. Perhaps his fear that he might be walking into an “ambush” was unfounded; in that event, the tasing could be excessive under prong one of the analysis. But even so, no authority cited by the plaintiffs remotely addresses the situation Escajeda faced. It follows, then, that Escajeda could not have been on notice that his single use of the taser was clearly unlawful.

The Supreme Court has periodically warned lower courts to not discuss situations too generally when dealing with immunity claims. Contrarily, it has also warned lower courts to not to allow specificity to get in the way of recognizing obvious rights violations even though there is no precedent exactly on point. Given these two competing options, the Fifth Circuit says it prefers specificity.

Furthermore, the district court did not “frame the constitutional question with specificity and granularity.” The court asked about the proper use of tasers “against a subdued person.” That is too general. It is one thing to ask whether police may tase someone after they have handcuffed him and put him face-down on the ground. It is quite another to ask whether an officer may tase someone who may be hanging himself, who may or may not have a weapon, who does not respond to the officer’s commands—all when the officer approaches him rapidly, alone, and in the dark.

It may be “quite another” question when “specificity and granularity” are compared to analogous cases not exactly on point. But this decision does more harm than good by allowing cops to place themselves in danger, act quickly, and walk away from the poor decisions they made after placing themselves under this stress. The officer approached the suicidal man “rapidly, alone, and in the dark.” If he truly believed the situation was dangerous, he would have acted differently, perhaps waiting for backup or seeking assistance from the man’s mother. Instead, the officer presented testimony that said he wanted to prevent a suicide but approached the scene as though he was the only one in danger of being harmed.

Contradictory motives are a sign of post-fuck up rationalization. The officer had options but placed himself in danger (a completely subjective statement) and then increased the perceived danger by “rapidly evolving” the situation. He should not be rewarded for doing his job poorly. But that is what happened here and continues to happen with alarming regularity in cases handled by this particular appeals court.

How A Corrupt Baltimore Police Task Force Tainted Thousands of Cases
Two Baltimore police officers are on trial this week in federal court for some of this worst misconduct imaginable. Detectives Daniel Hersl and Marcus Taylor were members of Baltimore’s Gun Trace Task Force, an elite group of plainclothes officers expected to get the worst firearms and offenders off the city streets.

Eight of the nine men on the task force have been accused of a range of organized crime-level charges that range from robbery and extortion, to faking evidence, planting drugs, dealing drugs, and other serious crimes. 6 of the officers, Sergeants Thomas Allers and Wayne Jenkins, and Detectives Momodu Gondo, Evodio Hendrix, Maurice Ward, and Jemell Rayam, have all pleaded guilty.

It’s a staggering fall: the Gun Trace Task Force was created by the city in 2007 with the explicit goal of fighting crime and reducing the city’s rising murder rate. For a while, city leaders saw the task force as a huge success, celebrating the firearms and drugs the men had confiscated.

Today, many Baltimore residents consider the task force’s crimes the biggest scandal in recent memory. Freddie Gray’s 2015 death in police custody and the resulting riots dominated years of headlines, but these officers’s misconduct was the low frequency chaos only people in Baltimore’s most vulnerable communities could hear.

NY judges agree with Eric Adams on fixing bail-reform law, court official says



New York’s judges overwhelmingly agree with Mayor Eric Adams that they should have greater control over setting bail for potentially dangerous defendants, the official in charge of court operations told lawmakers Tuesday.



“Many judges — we’ve got most of our judges who sit on criminal cases — would like more discretion in making determinations about bail and release of people accused of crimes,” Chief Administrative Judge Lawrence Marks said during a budget hearing in Albany.



The state’s judiciary doesn’t “have a formal proposal,” Marks said, before adding that he wasn’t “speaking for 100 percent of our judges.”



“But I think it’s fair to say that individual judges would like to have more discretion in making these decisions and feel that they would be able to fairly and effectively make decisions on a case-by-case basis,” he said.



“To me, that’s a fair characterization of how most judges who sit on criminal cases in the state Unified Court System feel.”

Marks’ comments came in response to a question from Assemblyman Ed Ra (R-Long Island), who noted that Adams on Monday called on state legislators to amend the controversial 2019 bail-reform laws so judges can consider the “dangerousness” of defendants before deciding the terms of their release, if at all.



Marks said he hadn’t “seen the details” of Adams’ proposal but was aware that “he did call for that.”



Under the bail-reform laws signed by then-Gov. Andrew Cuomo, judges can no longer order defendants charged with most misdemeanors and some felonies to post bail before being freed from custody.



And when a judge can set conditions for release, they have to be the “least restrictive” that will ensure a defendant returns to court, and not necessarily involve cash or a bail bond.



During a City Hall speech on gun violence, Adams said, “We must allow judges to take dangerousness into account” when setting bail or deciding to jail someone pending trial.



“New York is the only state in the country that does not allow a judge to detain a defendant who poses a threat to the community,” he said.



“Forty-nine other states, as well as the federal government, allow judges to consider a defendant’s dangerousness. New York must catch up.”

Brooklyn D.A.’s office to vacate 378 cases tied to dirty NYPD cops

The Brooklyn district attorney’s office wants to vacate nearly 400 criminal convictions tied to 13 dirty NYPD officers.




Brooklyn District Attorney Eric Gonzalez said he didn’t find misconduct in the cases, but his prosecutors “no longer have confidence” in the work of the officers — who were convicted of crimes running the gamut from perjury to planting drugs to accepting bribes.

Gonzalez’s office referred to the move as the sixth-largest mass dismissal of convictions in U.S. history.




Prosecutors were in Brooklyn Supreme Court Wednesday afternoon to request dismissals in 47 felony cases, and will do the same for 331 misdemeanor cases in Brooklyn Criminal Court later this month.




“These former police officers were found to have committed serious misconduct that directly relates to their official job duties, calling into question the integrity of every arrest they have made,” Gonzalez said. “A thorough review by my conviction review unit identified those cases in which their testimony was essential to proving guilt, and I will now move to dismiss those convictions as I no longer have confidence in the integrity of the evidence that underpinned them.”




Most of the cases involved drug-related charges.




The majority of the dismissals, 134 in total, were from cases built by former narcotics cop Jerry Bowens, who is serving a 40-year prison sentence after fatally shooting his estranged girlfriend and wounding her friend.




A year before the 2009 shooting, Bowens was indicted on charges he stole crack from drug suspects to give it to informants.




He was one of four cops convicted in a massive scandal involving the Brooklyn South narcotics squad. More than half of the cases Gonzalez is moving to dismiss are linked to those four cops.

Prosecutors are also moving to dismiss 60 cases involving Eddie Martins, one of two detectives accused of raping a former Brooklyn woman, who goes by the alias Anna Chambers, in the back of a police van in 2018.




The rape charges against Martins and his partner Richard Hall were dropped in March 2019 because of “credibility issues” the Brooklyn DA’s office had with Chambers, but the duo pleaded guilty to bribery and official misconduct in exchange for five years’ probation. Chambers has since filed a civil lawsuit against the city and the two ex-detectives.




Gonzalez’s office is seeking to dismiss 18 cases built by Hall.

Another 43 cases involved former Detective Oscar Sandino, who was convicted of sexually assaulting a woman inside a bathroom at the 110th Precinct stationhouse in Queens after he arrested her in 2006, and performing a lewd act in front of a woman prisoner in a secluded area of Brooklyn Criminal Court in 2009.

Prosecutors are also moving to dismiss 27 cases by Michael Foder, a disgraced former detective who was sentenced in 2019 to three months behind bars for perjury. He carried out unofficial photo lineups on WhatsApp, then falsified paperwork to make it look like he did them by the book, and lied under oath about how he identified perpetrators in a federal carjacking case.

Elizabeth Felber of the Legal Aid Society lauded Gonzalez’s decision, and urged prosecutors across the city to continue reviewing convictions as a matter of policy.




“While we applaud this decision, the people prosecuted in these cases were forced to endure hardships that should never have happened to begin with,” Felber said. “Some individuals lost years of their lives serving prison sentences and many suffered collateral harm including housing instability, loss of employment and severed access to critical services, all because of the words of these corrupt police officers.”

Biden Urges 'Fund The Police' As Cops Keep Killing Black People

On Tuesday, President Joe Biden delivered a fiery speech at Wilkes University in Pennsylvania. He started off well enough. He blasted “MAGA Republicans” and their “sickening” attacks on the FBI that came after the bureau raided the Mar-a-Lago property of their orangey-white nationalist overseer.



He also took a shot (so to speak) at gun nuts who think the Second Amendment of the U.S. Constitution doubles as a Bible verse.





“For those brave right-wing Americans who say is all about keeping America independent and safe, if you want to fight against the country, you need an F-15,” Biden said. “You need something a little more than a gun.” (Oh sh^t! Shots fired! Again—so to speak.)



But then Biden’s speech took a turn. He reminded us that he’s a politician first and a person who’s interested in the truth of a matter second. He decided, like many politicians before him, to obfuscate what is actually meant by “defund the police.”





“Want to feel a sense of security? That’s what my crime plan is all about. You know, I call it the Safer Americans Plan. And both your members of Congress voted for it. It’s based on a simple notion. When it comes to public safety to this stage, the answer is not defund the police. It’s fund the police,” Biden said.



Meanwhile, Biden’s speech came as police appeared to be continuing to kill Black and brown people with impunity. For instance, the president pushed his “fund the police” agenda hours after police in Columbus, Ohio, shot and killed Donovan Lewis within one second of seeing the 20-year-old unarmed Black man in his bedroom at around 2 a.m. Police apparently mistook his vape pen for a gun.



As the New York Times noted in 2020—when “defund the police” became an activist rallying cry—”Calls to defund police departments are generally seeking spending cuts to police forces that have consumed ever larger shares of city budgets in many cities and towns.” It’s not a call to abolish the police. (That’s a separate rallying cry, actually.) It just means not giving them more power than they need.



But Biden is a politician and politicians don’t typically dabble in nuance. Talking points for political furtherance is an elected official’s game, and speaking against defunding without being clear on what defunding entails is just a good strategy. Who cares about the truth?



It’s also worth mentioning that hours before Biden’s Pennsylvania speech, a Black man, Donovan Lewis, was shot and killed by a police officer in the neighboring state of Ohio while police were executing an arrest warrant. He was shot as soon as a cop opened his bedroom door. He was armed with nothing but a vape pen. To be clear, defunding the police would not have stopped that from happening—I’m just saying it indicates that we need to take a closer look at how policing is done. Opponents of the call to defund make it clear that they’re not even interested in doing that much.



It’s also worth mentioning that one of the first times Biden championed a bill that give police officers more power was the 1994 crime bill, and, well, we know how that turned out for the Black community.



One could easily argue that he’s at it again.

Biden has requested $35 billion in the 2023 fiscal year budget to fund the police and services that address the causes of crime. The “Safer America Plan” also calls “on Congress to require background checks for all gun sales and ban assault weapons and high-capacity magazines.”



“I’m determined to ban assault weapons in this country! Determined,” he said.



Biden then noted the recent mass shootings across the country, including in Buffalo, N.Y. and Uvalde, Texas, saying “more children die from guns than active duty police and active duty military personnel combined.”



Sounds like policy that might help combat one American problem and potentially exacerbate another all packed into one bill.



Or maybe it’s all just a political dance.

Could GOP calls to 'defund' FBI boost Democrats in midterm elections?

Republicans have pushed a mantra of "defund the FBI" in the aftermath of the FBI’s search of Trump's Mar-a-lago residence.

Democrats are framing calls to "defund the FBI" as the latest example of an increasingly extreme "ultra-MAGA" Republican Party.

Experts are divided on what extent “defund the FBI” will hurt Republicans during the midterms.

WASHINGTON –  Don Bolduc, the front-runner to win the Republican nomination for U.S. Senate in New Hampshire, said he's open to eliminating the FBI, prompting loud cheers during a GOP primary debate this month.

Bruce Fenton, another contender, was more unequivocal: "We should abolish the FBI and replace it with nothing."
